Today News
April 15, 2015 year Eltechs released the most updated applications ExaGear Strategies and ExaGear RPG!
First of all we have increased performance, and now games are loaded 12% faster!

Eltechs support a couple of new iconic games:

    Panzer General 2 on ExaGear Strategies
    Arcanum on ExaGear RPG
    Jagged Alliance 2 on ExaGear RPG

And now ExaGear is fully compatible with 64-bit devices (like Nexus 9, HTC One M9, LG G Flex 2 etc).

What else is new? Eltechs made more flexible payment options.
As you know emulator is free to use for three days after installation. After that period in order to continue you should select one of the following options:
Choose controls package and buy it. In this case you pay once and use selected controls package for unlimited time. Note that each controls package is paid separately!
Activate the subscription for all controls packages of ExaGear Strategies and ExaGear RPG. In this case you initiate payment for the first month and can use all controls packages of ExaGear Strategies and ExaGear RPG for a month. Starting from the second month, you will automatically be charged. Successful charge extends the subscription for a month. If you cancel the subscription you will not be charged automatically starting from the next month, and you will have access to the subscription until the end of the current (paid) months.

sound like bad joke for me,anyway i must agree with slax .Small hint for some comercial programs are free in trial mod,free for 14-30 days period,3 day are too short

JA2 Classic HD ( actually 1.13 ) onsale at Steam . Apart from the legal position ( CAN it be legal ? ) , the game is as we know it , very playable and has all bells/whistles of the latest 1.13 , added also is Classic JA2 and Wildfire . £6 and some pence .

I tried to ask Rowa if he knows anything about it (hasn't replied yet), the whole JA2HD thing looks fishy as hell, if you ask me. Publishers Topware and I-deal? Wtf... Using v1.13? Without even asking?

Bought it on Steam out of morbid curiosity and it is, indeed, 1.13 mod (build 7609) bundled with the US Gold version of the original game.
Also buying it requires you to have Wildfire on Steam for presumably no other reason than Topware being its publisher.

I don't suppose anyone on the forum is an IP Lawyer looking to do some pro bono work on behalf of the community.

This is (insert some choice words) unacceptable! I am not a coder but those who are and have put thousands of hours into modding the game must be furious. Are they even allowed to sell it? Aside from the fact that they don't own JA 2 1.13 doesn't the open source agreement which came with the gold release allowing for the mods we all know and love specifically state that you can't sell or make a profit from the work? And which mod will be next? Urban chaos? Vengeance reloaded? AIMNAS? Bigmaps? Vacations? Revisited?

There has to be something that can be done.

So apparently they're selling JA2 as a DLC for Wildfire and as a "bonus" they thought it would be nice to add v1.13. Just that idea, JA2 as DLC for Wildfire, is so immoral and such a lame cash grab it deserves full outrage.

Wildfire is a standalone game that was published by Zuxxez Entertainment AG. 1.13 is based on the Wildfire source code, right? Now these people on steam claim to have acquired rights from the former publisher (which must be Zuxxez) who didn't even have the rights themselves (according to Wikipedia). What?
And they are using the 1.13 code to run the game but they "only provide that for convenience". Err, what???

In my opinion they can sell the original Wildfire if they got an agreement with Zuxxez but 1.13 is off limits.

The main problem I see is that product name "Jagged Alliance 2 Classic HD" is misleading, as original Ja2 they actually sell doesn't support high resolutions, and HD is provided by the 1.13 mod which they "provide for free" but which is needed to get that "HD" function. I doubt this is legal at all to sell community mod this way.

Also, while they added "The fan mod V1.13 is provided for free, but not officially supported." to product description recently, there is no link to 1.13 community or any information who actually made it and where to download official mod version.

If someone wants to contact these people, they posted email on steam forum:

Nordic Games owns the IP, but from my talks with JAF devs each company that bought the right to develop a version got with the "lease" the right to use whatever assets game already had. But in no iteration did anyone get v1.13 as official package.

The following is the Source Code license agreement that governs whatever gave birth to v1.13 and other source code mods:

SFI went bankrupt, sold IP to bitComposer who went bankrupt and sold IP to Nordic Games. That's the last owner who in theory could use the source code mods without asking.
Funny trivia - SFI and i-Deal were suing each other back then. Also SFI, when JA2UC was released, came to us and actually proposed a deal of like $2 for each JA2UC game sold, if we ALLOWED them to publish it commercially. Legally we couldn't since it was a community effort, so they DID NOT TOUCH IT. In spite of the agreement saying so, they didn't dare open a can of worms with 3rd party copyright infrigements, EULA or not. As a matter of fact, their publishing deal included a small clause that made Bear's Pit responsible in case of such claims... so no thanks, we said. We forego a decent lump of cash (considering JA2UC hit well over 100k downloads fast) but we felt it wasn't right, despite our team being the authors of like 80-90% of the work (the rest being random contributors who added bits and pieces over the years).

Zuzzex/Topware are some ghost companies already bankrupt who, well before v1.13 was made (definitely well before that specific v1.13 build was published) had limited distribution deal with Sir-tech and the SFI. In no way shape of form they ever held complete rights over the modifications to the JA2 source code. Looks like someone faceless liquidator has recently bought them at a basement price and now is trying to do a garden sale of their remains. This definitely needs to be stopped.

Out of curiosity, what % of original and unmodified code from JA2 Gold Edition is still used in 1.13? Surely by now just about every part of the game has been modded in some small way, if not completely overhauled or removed and replaced entirely.

That somehwat depends on what you mean by modified. I mean, at some point the original code was ported to C++ by the white heads. In that regard, everything has been modified. But even if you are not taking that into account... I still think all files, honestly. I mean, I'm only at this for a few years, and I've probably touched almost all of them. Taking into account all devs - that should be all files.

The amount of code text (c, cpp, h files) in 7609 (which is 3 years old) is doubled compared to original Ja2 (35mb vs 17mb of code).
It's not very representative but gives an idea of how much the code was modified.

Also, I seem to recall you being closely related with the implementation of the higher resolutions, do you know where the exact thread is? The search function is singularly unhelpful nowadays. Specifically, I seem to recall that the post with high res on the store page (last pic) was originally posted in that thread here (it also clearly displays Vinny as a merc, which I think was implemented for 1.13 by anv, which is an obvious second strike).

Looks like they removed HD from the name of the DLC now. Also from the DLC image.
They're still selling 1.13 without permission so it changes nothing.

Don't think I made a post for the centering of strategic screen in higher resolutions.

1.13 is a community mod and should always be a freely-distributed mod.
1.13 (or any other community mods) should not be bundled with any other paid software without the modder(s)' explicit permission.

IMO, the only probable way of permission granted by the 1.13 community (however minute it could be) is to have 1.13 mod as a 'standalone & free' DLC with proper attribution in product title & description with mod name, version & community support link etc.

Please liaise with Shanga (if he's willing & the community is ok) on steam.

In the meantime, please remove all 1.13 references which includes, and not limited to,
- 'HD' wordings as 'original Version of Jagged Alliance 2' is 640x480 only.
- 1.13 screenshots
- most importantly, all 1.13 related files from the DLC.

1 way of value adding is to have win8 & win10 official support for 'original Version of Jagged Alliance 2'.
Still, a pat on their work in having Mac OS and Linux support for 'Jagged Alliance 2 - Wildfire'.

Regards to the 'original Version of Jagged Alliance 2' DLC, could you check:
1. Whether 1.13 mod can be installed optionally?
2. If can be installed optionally, is the default option for 1.13 mod installation marked as 'excluded' aka 'installation checkbox untick'?

If it's a NO on either of the above, there's (IMO) a clear copyright infringement.
Oh, if 1.13 mod is NOT an optional installation, how could TopWare Interactive sells the DLC but [still] not officially supported?

@Buggler, there are no choices on install, it just dumps two folders into your Wildfire directory:
- "JA2Classic" which has an added TopWare splash screen on start and seems to not even be US Gold like I reported earlier: it says "VERSION: RELEASE V. 1.03 (BUILD 99.06.09)"
- "JA2ClassicHD" which is reported as "VERSION: JAGGED ALLIANCE 2 V1.13.7609 (2014 OFFICIAL RELEASE) BUILD 14.10.24"
That's all their installer does aside from adding 2 shortcuts to those on your desktop.

Another possible problem is that 1.13 code can use some external code not written by community like libraries for multiplayer or compressed files or PNG support etc.
As far as I know this type of code often uses license that directly prohibits any commercial use in any form.

Not even mentioning that 1.13 resources may contain modified content from other commercial products like pictures/voices etc, when someone starts making the money from it - it may become a problem.

I've just received another email from steam after that, basically saying that they've sent my complaint to the publisher and will remove the game from the store. Not entirely sure whether this happens immediately or if there will be a back-and-forth between them, but this seems to be going in the right direction.

Good to hear, Flugente. Disrespectful scum as they are... Well, I don't have code in it, just some graphical parts (items, UI) dating way back. Maybe a bit difficult to make a formal complaint about that. But knowing how much energy some people of this community have spent in v.1.13 and everything around along the years... I hope this will be solved quickly.

This doesn't even needs to be argued. The JA2 source code modifications are governed by the Strategy First licensing agreement, included with the package, when the thing was released. And that plainly states:

This Software includes source code or data, and you may modify such portions of the Software and distribute the modified Software for non-commercial purposes, as provided in this Licensing Agreement.


Again, Zuzzex/Topware was never IP holder, just a licenser who handled German localisation (and Wildfire, I think). To even DREAM about using v1.13 they would need written agreement from both current IP holder (Nordic Games) and written agreements from ALL persons who ever added one line of code or one pixel of paint in v1.13. They did neither.

I am glad Valve is moving on the case. This needs to end. Hope that guy who handles Talonsoft Steam gets to look for a new job, preferably outside gaming industry.

Ok, I plead guilty, I should have done this a few days ago already. This post may be a bit long but I'll make every effort to be thorough, calm and factual.

A few chronological facts first :
- september 2012 : we release Transcripted on Steam with a publisher, Topware Interactive
- october 2012 : things start to go wrong when Topware breaches several major clauses of our publishing deals
- february 2013 : we file an official complaint against Topware under the jurisdiction of the court of Cologne, Germany
- march 2013 : Valve kindly removes Transcripted from the Steam store at our demand until we have settled our dispute.
- 2013 - 2015 : Topware has sold Transcripted on multiple digital stores often lowering the price by 90% or giving in large bundles of games starting sometimes at 1$ of course without our consent. During that period we regularly tried to contact several stores to ask them not to sell our game during the legal procedure. By lack of financial means, we never were able to force anyone to comply.
- august 2015 : Topware is found guilty of breaches in our publishing deal and sentenced to pay us 19 000 euros. The publishing deal is revoked (we can do whatever we want with our game)
- october 2015 : Topware is insolvent and can't pay // Official end of the publishing deal even if it was not broken by the court.
- march 2016 : Topware which is supposed to be in liquidation announces a major title (Two Worlds III) and is still selling our game on multiple digital outlets (Topware's shop, amazon, fnac, ebay...)
- june 2016 : we finally find the time to work once more on Transcripted to re-fit a proper version, with a few bug fixes and improvements
- july 2016 :

A few other bunch of facts :
- we don't know every sites where our game was sold
- we don't know how much copies of the game were sold or given away in bundles
- we were paid only 10 000 euros of the 40 000 euros stated in the contract for the retail physical version (on which no rev share was agreed)
- we were never paid a single euro of the rev share that was agreed
- we never received a single sales report until the court of Cologne forced Topware to do so. The only report we did get at that point was shady and incomplete at best.
- to this day Topware is still completely illegally selling our game on multiple digital stores including their own website
- we already invested around 10 000 euros of legal procedure (lawyer, court fees, contract translation) for no obvious result.
- we always had the IP of our game but we really recover the right to publish our game by ourselves in august 2015.
- we don't know who operates Topware today or even if it's still an actual company
