The best condition to improve the odds is that the enemy is "collapsed" (the term the source code uses for unconcious) and wounded to some degree (it's Life value must be smaller than the OKLIFE value, wich I think is reffering to that enemies full health points).
The changes to steal a weapon from an enemy are ranging from 0 to 100. There are some conditions in wich the game offers a bonus to the chances to steal. I will use the term hit chances, as stealing is considered in the source code a type of HTH attack (it does not have anything to do with the HtH trait, tough, stabing is also considered a HtH attack but it's trait is Kniffing).
There are two kind of bonuses to the hit chances:

1. If your merc managed to get near the enemy undetected. After the game calculates the difference between the stealing merc's physical attributes (health, etc) and the enemy's attributes, 20 points are addes to the result. Than the game makes a dice roll and if the dice roll is smaller or equal compared with the hit chances, you have a succesfull stealing.

2. If the enemy is collapsed, THE HIT CHANCES ARE SET TO 100. Then, the hit chances are compared with the dice roll, and if the dice roll result is smaller, than you have a succesfull stealing.

3. There are certain relative positions of your merc and the enemy in wich stealing is not possible. If you try once and see that the stealing was unsuccesfull, just move your merc to the other side of the enemy and try it from there.

4. The state of your merc's primary hand slot has nothing to do with the chances to make a steal. If your merc's primary hand slot is full and the dice roll is higher than 2/3 of the chances to hit, the the weapon falls to the ground, if not, the weapons goes in the merc's primary hand slot and the item in that slot goes into the merc's inventory.

So the best way to have maximum chances to steal a weapon is to attempt the steal when the enemy is "collapsed". Be it from stun grenades, tear gas grenades or enough punches.

Both succesfull and unsuccesfull attemps to steal are giving some experience "points". Of course, a merc gains more experience points when he makes a succesfull stealing,
