Did you tried from the other side of that unconscious enemy in critical state? I know that somehow the game takes into account the relative positions on the world's grid of the two "soldiers", but didn't had the time last night to look deeper into the code and see how does this affect the stealing chances, but from my experience I know that it's true. I tried sometimes twice or even trice to steal a weapon from a position and when moved the merc on the other side of the fallen enemy it was able to steal the weapon.
